Trademarks are names, logos, taglines and any other symbols that a business uses to distinguish their products and services in the marketplace. To be able to function as a trademark, the name, logo, tagline or other symbol can’t be descriptive of your products or services and it must be unique in your industry.

How much does a trademark registration cost in Canada?

The cost of a trademark registration in Canada varies depending on whether you DIY the registration or your hire a trademark lawyer or agent to assist or to register the trademark for you. If you DIY the registration, the cost is limited to Canadian government filing fees, which are based on the number of classes of goods and services claimed in your trademark application. One class of goods/services costs $336.60 and each additional class costs $102. A trademark application that covers 3 classes, for example, would cost $540.60 ($336.60 + $102 + $102).

If you hire a trademark lawyer or agent to register the trademark for you, the cost typically ranges between $1000 to $2000, plus Canadian government filing fees. When should I retain a lawyer to complete a trademark registration?

How long do trademarks take to be approved?

In Canada, it takes about 2 to 2.5 years for a trademark to be approved. Given this delay, we strongly recommend conducting an in-depth trademark search before you start using your trademark, and you apply to trademark as early as possible.

How long do trademarks last?

A trademark lasts 10-years from the date of registration, and it can be renewed for further successive 10-year periods.

Is it necessary to register trademark?

A trademark registration is necessary if you want to own your trademark. While owners of unregistered trademarks do have a limited ability to stop others from passing off their trademarks, only registered trademark owners can sue someone for trademark infringement and for depreciating the value of the goodwill associated with the trademark.
