A trademark registration grants you the exclusive right to use a trademark throughout Canada and the ability to stop others from using the same or a confusingly similar trademark. Essentially, a trademark registration grants you ownership of your trademark in Canada. A trademark registration can also be used to have infringing social media posts and account names quickly and inexpensively taken down.

How can I protect my logo in Canada?

The best way to protect your logo in Canada is to register it as your trademark. The application to register a trademark must be filed with the Canadian Intellectual Property Office, which will examine the application for compliance with trademark laws, advertise it for public opposition, and at the end of the process issue a certificate of registration granting you exclusive ownership of the logo for a period of 10-years.

Can I sue someone for infringing my trademark?

If you have registered your trademark in Canada, you can sue someone for infringing it. Trademark infringement is a cause of action that is only available to registered Canadian trademark owners. If your trademark is not registered, you may still be able to sue for trademark passing off.
